These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Mohd Rijvan Khan Mogia ("Developer"), operating under the IndianAI Google Play Console account, regarding your use of the InshortAI mobile application ("App").

By accessing or using the App, you confirm that you are at least 13 years of age and that you accept these Terms in full. If you are between 13 and 18, you should use the app under parental or guardian supervision.

2. AI Disclaimer — Important

2.1 Accuracy of AI Responses

InshortAI provides AI-generated answers powered by Google Gemini. While we strive to deliver accurate and relevant information, you acknowledge and agree that:

• AI responses are generated automatically and may contain errors, inaccuracies, or outdated information.
• Answers are limited to approximately 60 words, which may omit important context or nuance.
• The AI may occasionally generate incorrect, misleading, or incomplete responses.
• The Developer makes no warranties, express or implied, regarding the accuracy, completeness, or reliability of AI-generated content.

2.2 No Medical Advice

InshortAI is NOT a medical application. Any health-related information provided by the App is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. You should never rely on InshortAI for medical decisions. Always consult a qualified healthcare professional for medical advice, diagnosis, or treatment options.

2.3 No Legal Advice

InshortAI is NOT a legal service. Any legal information provided by the App is for general informational purposes only and does not constitute legal advice. Do not act on any legal information obtained from InshortAI without first consulting a qualified legal professional.

2.4 No Financial Advice

InshortAI is NOT a financial advisor. Any financial, investment, tax, or economic information provided by the App is for general educational purposes only. Do not make financial decisions based solely on InshortAI responses without consulting a qualified financial advisor.

2.5 Emergency Situations

InshortAI is not suitable for emergency situations. In any emergency, please contact the appropriate emergency services (such as 112, 100, 101, 102 in India) immediately. Do not rely on InshortAI for emergency guidance.

3. Google Gemini API Terms

InshortAI uses the Google Gemini API. By using InshortAI, you also agree to comply with Google's terms and policies applicable to the Gemini API, including but not limited to:

• Google Terms of Service
• Google Privacy Policy

You are responsible for ensuring that your use of the App and the Gemini API complies with applicable laws and Google's usage policies. The Developer is not liable for any violations of Google's terms by individual users.

The availability of Google Gemini API services is subject to Google's discretion and uptime guarantees. The Developer is not responsible for any service interruptions caused by Google's API availability, rate limits, or policy changes.

4. API Key Responsibility

InshortAI requires a valid Google Gemini API key to function. You are solely responsible for:

• Obtaining a valid API key from Google AI Studio.
• Keeping your API key secure and confidential.
• All usage of the Gemini API through your API key, including any associated costs or quota overages.
• Ensuring your API key usage complies with Google's terms of service.

The Developer is not responsible for any charges, quota overages, or consequences arising from your use or misuse of a Gemini API key.

5. Permitted Use

You may use InshortAI for personal, non-commercial, lawful purposes. You agree to:

• Use the App only for legitimate informational purposes.
• Not attempt to reverse engineer, decompile, or modify the App.
• Not use the App to generate harmful, illegal, or inappropriate content.
• Not use the App in any way that violates applicable laws or regulations.
• Not attempt to circumvent any usage limits or security measures in the App.

6. Prohibited Use

You must not use InshortAI to:

• Ask questions intended to generate harmful, abusive, discriminatory, or illegal content.
• Attempt to extract confidential system prompts or circumvent AI safety guidelines.
• Use the app for spamming, automated scraping, or bulk data collection.
• Impersonate individuals or organizations.
• Engage in any activity that violates Google's Gemini API usage policies.

7. Intellectual Property

The InshortAI application, including its design, code, branding, and non-AI-generated content, is the intellectual property of Mohd Rijvan Khan Mogia / IndianAI. All rights are reserved.

AI-generated responses are produced by Google Gemini and are subject to Google's intellectual property policies. The Developer does not claim ownership of AI-generated content.

You may copy individual AI-generated answers for your personal, non-commercial use (e.g., using the copy button feature). Bulk reproduction or redistribution of App content is not permitted.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for:

• Any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App.
• Any loss of data, profit, or business resulting from App usage.
• Any inaccuracies or errors in AI-generated content.
• Any decisions made by you in reliance on information provided by the App.
• Any interruption, suspension, or termination of the App or Gemini API services.
• Any unauthorized access to your device or API key by third parties.

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.

9. Disclaimer of Warranties

InshortAI is provided without any warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose.
• Warranties that the App will be uninterrupted, error-free, or free of viruses.
• Warranties regarding the accuracy or completeness of AI-generated answers.

10. User Responsibilities

As a user of InshortAI, you take full responsibility for:

• Verifying important information from trusted, authoritative sources before acting on it.
• Using the app responsibly and in accordance with applicable laws.
• Securing your device and Gemini API key.
• Understanding that AI responses are generated automatically and may not reflect current events, local regulations, or your specific circumstances.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. The "Last Updated" date at the top of this page will reflect the date of the most recent revision.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree with modified Terms, you should stop using the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Maharashtra, India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
